BEPS Final Regulations and Compliance

Background
By Notice of Final Rulemaking, issued Friday, November 5, 2021, the District of Columbia Department of Energy and Environment (DOEE) adopted final regulations governing the implementation and enforcement of the “Building Energy Performance Standards” or “BEPS.” As adopted, BEPS requires buildings located in the District of Columbia to meet specific energy savings and building efficiency standards or targets at predetermined intervals. Failure to comply with the applicable standard or target could subject you or your company to significant fines and penalties. By separate “Notice,” issued October 22, 2021, DOEE also issued final regulations governing the “benchmarking” or building performance data for buildings located in the District of Columbia.
